FCRA Disclosure & Summary of Rights

This document is provided to you in accordance with the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA"). Please read it carefully. It is a standalone disclosure — separate from Tekyeka's Terms of Service and Privacy Policy.

1. FCRA Disclosure

IMPORTANT NOTICE — PLEASE READ

In connection with your application to become a Provider on the Tekyeka platform, Tekyeka LLC may obtain a consumer report (background check) about you from Checkr, Inc., a Consumer Reporting Agency (CRA) as defined under the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq.

The consumer report may be used as a factor in determining your eligibility to become a Provider on the Tekyeka platform. This disclosure is made pursuant to 15 U.S.C. § 1681b(b)(2)(A).

This disclosure is provided solely for the purpose of informing you of your rights under the FCRA and obtaining your authorization to procure a consumer report. It is not part of any other document.

3. Nature and Scope of the Report

The consumer report obtained from Checkr may include, but is not limited to, the following types of information:

  • Social Security Number (SSN) trace and address history
  • National criminal records search
  • Sex offender registry search
  • Global watchlist search (OFAC, terrorist watchlists, and similar databases)
  • County and state criminal records searches based on address history

The report will be used solely to evaluate your application to become a Provider on the Tekyeka platform in compliance with applicable federal, state, and local laws.

4. Your Rights Under the FCRA

You have the following rights under the Fair Credit Reporting Act:

  • Right to a Free Copy of Your Report. You have the right to obtain a free copy of the consumer report from Checkr if you request it within 60 days of receiving notice that adverse action has been taken against you based on the report. You may also request a free copy annually.
  • Right to Dispute Inaccurate Information. If you believe any information in your consumer report is inaccurate or incomplete, you have the right to dispute it with Checkr directly. Checkr is required to investigate your dispute and correct or delete inaccurate, incomplete, or unverifiable information.
  • Right to Know if Information Was Used Against You. If we take an adverse action against you (such as declining your application) based in whole or in part on information from a consumer report, we will provide you with a pre-adverse action notice, a copy of the report, and a summary of your rights under the FCRA before the adverse action is finalized.
  • Right to Limit Certain Disclosures.You have the right to opt out of having your consumer report shared with certain third parties. See Checkr's Privacy Policy for details.
  • Right to Seek Damages. If a CRA, user of consumer reports, or furnisher of information to a CRA violates the FCRA, you may be able to sue in state or federal court.

5. Adverse Action Rights

If Tekyeka decides to take adverse action against you (including denying or revoking your Provider status) based in whole or in part on a consumer report from Checkr:

  • We will provide you with a Pre-Adverse Action Notice and a copy of the report before the final decision is made, giving you an opportunity to review and dispute any information.
  • You will have a reasonable period to review the report and dispute inaccuracies with Checkr before the final decision is communicated.
  • After the final decision, we will provide you with an Adverse Action Notice including the name, address, and phone number of Checkr and a statement that Checkr did not make the adverse decision and cannot explain why it was made.

A Summary of Your Rights Under the Fair Credit Reporting Act

The federal Fair Credit Reporting Act (FCRA) promotes the accuracy, fairness, and privacy of information in the files of consumer reporting agencies. There are many types of consumer reporting agencies, including credit bureaus and specialty agencies (such as agencies that sell information about check writing histories, medical records, and rental history records). Here is a summary of your major rights under FCRA. For more information, including information about additional rights, go to www.consumerfinance.gov or write to: Consumer Financial Protection Bureau, 1700 G Street N.W., Washington, DC 20552.

  • You must be told if information in your file has been used against you. Anyone who uses a credit report or another type of consumer report to deny your application for credit, insurance, or employment — or to take another adverse action against you — must tell you, and must give you the name, address, and phone number of the agency that provided the information.
  • You have the right to know what is in your file. You may request and obtain all the information about you in the files of a consumer reporting agency (your "file disclosure"). You will be required to provide proper identification, which may include your Social Security number. In many cases, the disclosure will be free.
  • You have the right to ask for a credit score. Consumer reporting agencies must provide you with a credit score if requested.
  • You have the right to dispute incomplete or inaccurate information. If you identify information in your file that is incomplete or inaccurate, and report it to the consumer reporting agency, the agency must investigate unless your dispute is frivolous.
  • Consumer reporting agencies must correct or delete inaccurate, incomplete, or unverifiable information. Inaccurate, incomplete, or unverifiable information must be removed or corrected, usually within 30 days.
  • Consumer reporting agencies may not report outdated negative information. In most cases, a CRA may not report negative information that is more than seven years old, or bankruptcies that are more than 10 years old.
  • Access to your file is limited. A consumer reporting agency may provide information about you only to people with a valid need — usually to consider an application with a creditor, insurer, employer, landlord, or other business.
  • You must give your consent for reports to be provided to employers. A consumer reporting agency may not give out information about you to your employer, or a potential employer, without your written consent given to the employer.
  • You may limit "prescreened" offers of credit and insurance you get based on information in your credit report. Unsolicited "prescreened" offers for credit and insurance must include a toll-free phone number you can call if you choose to remove your name and address from the lists these offers are based on.
  • You may seek damages from violators. If a consumer reporting agency, or, in some cases, a user of consumer reports or a furnisher of information to a consumer reporting agency violates the FCRA, you may be able to sue in state or federal court.
  • Identity theft victims and active duty military personnel have additional rights. For more information, visit www.consumerfinance.gov.

States may enforce the FCRA, and many states have their own consumer reporting laws. In some cases, you may have more rights under state law. For more information, contact your state or local consumer protection agency or your state Attorney General.
